Hello,
Here is my situation.
Status : H1B Visa
GC Status : I-140 Approved in EB3
Priority Date : May 2004
Years on H1B: 9 years
H1B Expire date: 01/2012
Please advice if i can change my employer now or it will be too risky. I was hoping to accept new positions if new employer is willing to sponsor a h1b and green card from begining. So i can retain my previous PD.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

USCIS updated its count of FY2011 cap-subject H-1B petitions and advanced degree cap-exempt petitions receipted. As of 8/20/10, approximately 33,900 H-1B cap-subject petitions were receipted. USCIS has receipted 12,600 H-1B petitions for aliens with advanced degrees. This is a major jump from the last update of August 13, 2010 where only 29,700 filings were reported.
Is this trend likely to continue? We think so, expect visas to run out by the early weeks of December.

Hi All,
I got H1 B visa recently which has been processed by my consultant. Right now I am working in india. My current employer is asking me to go for an assignment to US with L1 Visa. My question is :
1) Do i get any problem for my current H1 visa, If I attend again to Embassy for L1.
Some of my friends are telling me that my current H1B visa will be cancelled in order to get L1 .. Please any one clarify my doubt...

My H-1 was approved in 2004 by the Texas Service Center. According to the instructions for I-539, for change of status to H4, it says:
"If The principal’s petition and change of status request are approved, mail form I-539 to the same Service Center that approved the principal’s I-129 and change of status or extension application. Include a copy of the principal’s approval notice."

My case was filed on july 2 and got rejected due to incorrect fees. I was told, it was mail room error and was refiled on Sep 12th. I was under the impression that all the rejected cases have receipts numbers and the cases are entered in USCIS database.
I called USCIS and my case information is not in database yet. My attorney told me that they only have a reference number for inquiry(yet to explain why no receipt number instead).
Have you guys seen this happening in other cases?

My aunt (father�s sister) is separated (not divorced) from her husband for over 17 years now. She and her 24 year old son (who was 7 years old when his parents separated) live with our family for last 17 years. Her application for visitor visa was rejected in year 2003 when I had invited her to attend my graduation ceremony. At that time I had not sent a sponsor letter. I have invited her to visit me again and this time I am sponsoring for her visit. She owns a house in India and her son owns a business.
Would her marital status (separated but not divorced) create any issues during the interview?

Hey all,
I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.
I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.

Yes. The old labor is valid for 180 days after July 16th.
