    I am all for cleaning the system and reforming H1B - but I oppose an ill conceived half measure such as the one Senator Durbin/Grassley is proposing.

    My main concern is two fold:
    1. Let us assume I am a very bright individual and I am currently in Harvard. If I graduate from Harvard Business School, and I want to join McKenzie, can I do that? Can I ever be a Management consultant in US if I want to (read I as any random Joe who is not US citizen/GC holder)

    2. Can I switch jobs within a couple of weeks if I need to (I refers to someone who works for a good company but perceives opportunities else where) - this is important as my competition (US citizen/GC holder) has no restriction in place for them. This is also important during recession when I might be a valuable asset to another company but the company cannot afford to wait.

    My point is: definitely prevent abuse of the system, but not by putting more shackles on the hapless employee. Give the employee freedom to move anywhere for a certain period of time (could be 3 yrs renewable 2 times as per current H1b) and have strict penalties if this employee overstays visa etc.

    Additionally, if employers abuse the system, send them to jail right away (and have whistle blower immigrant status protection). Make employers more accountable than they are today.

    Just my 2 cents.....

    Thanks UN. Just a follow up question, how would you advise to cases where the labor was filed at client location and the employee shifted to another state right after the 140 approval. I guess in this case there is no chance of convincing USCIS about AC-21 invokation. How would you act if such query comes up? Or is there a chance to get this query these days at the time of 485 processing.? Thanks in advance. With this, I would have all my doubts clarified regarding the work location. And also, I hope it does to so many others.

    Stating the obvious: Your attorney was a knucklehead?

    USCIS hasn't gone to zero tolerance on 140/485 so it is doubtful that you will get such a query.

    Are you still on H-1b?

    If you want to bullet proof yourself then do an eb2 labor now; port the priority date and then inter-file the 485 or file new 485 on eb2 140 which would have been done appropriately. You can get your greencard dependency on the new 140 without losing much in terms of waiting and getting peace of mind.

    You have rekindled my interest. I am not a lawyer but have been in a job that required reading contracts and legal matters. Your points made me think that we may have some case here. So if you are intersted we could take some legal opinion. If four or five people can join then we can share the cost for the initial consultation.

    Of course porting is derived from law!
    As I was pointing out earlier, this debate has become warperd. The question is about porting with BS+5, not porting per se. I believe the BS+5 came from a legacy INS memo after a lawsuit or something. Perhaps we should ask the question on one of the attorney forums.

    UN, you are God, thanks for the clear answers. I have one more, what are the reasons for I-140 denials, i.e what are the pitfalls to watch out for? Its been almost a year since I filed my I-140 in NSC and no response yet with a LUD of 10/6/2006, its troubling because my 7th yr H1 is expiring in a month and my lawyer wants to wait and see if the I-140 gets approved before then to file a 3 yr extension (we already applied the I-485). I am worried because of the potential of serious problems resulting from an unfavorable adjudication of my I-140.


    There is mainly two things for denial: ability to pay and person not meeting the education and experience requirement.

    Now; some of the things that USCiS goes after: close relative owning the compay; no registered office or just a virtual office in a particular fast processing state; too many 140's (ability to pay); in merger situations;not substantially all assets and liabilities were acquired by the successor entity (greencard labor rules in successor are different then h-1b situation).

    The job description can be put in the way that points to your plus points. If you go the Harvard Biz. school you will have those. I dont think they want you to leave. There will be other avenues out there.

    i am a physician and in the same boat as you. my employer searched high and dry before i came along. but you are missing something here. except universities that can hire the "best candidate", every other employer has to employ a citizen/gc applicant with the "minimum qualifications for the job". please revisit the rules if you do not understand this. your talent and extra skills count for nothing. employers cannot take the best applicant...if an LCA is needed. this is a very significant problem if applied to H1B renewals. Any tom dick and harry can displace you every 3 years. think about it please, not just your own situation. i am strongly in favor of H1B reform. i believe that this if linked with a bill like strive dramatically increase support for retrogression relief. however the reform needs to be thought through carefully. a 6 mnth LCA process for each renewal would kill us. let's not throw the baby out with the bathwater...

    credited with plundering and devastating north-western India time
    and time again in the eleventh and twelfth centuries.

    In their enthusiasm to score brownie points, the Pakistanis have
    got mixed up on chronology, they have produced Ghauri before
    Ghaznavi. Also, they have perversely sought to commemorate these
    Afghan rulers of Turkish descent in utter disregard of the fact
    that most of the territories they plundered are their own - the
    North West Frontier Province, the Punjab and Sind. The men and
    women they tortured, enslaved, ravished and put to the sword were
    their own forebears.

    If Pakistanis wish to revel in the inglorious misdeeds of
    foreigners perpetrated on their own soil and on their own
    ancestors, they are welcome to twirl their moustaches in euphoria
    and say: " Where ignorance is bliss, it is folly to he wise."

    Indians may look forward to future generations of Pakistani IRBMs
    and similar sophisticated weaponry named after the likes of
    Changez Khan, Nadir Shah and Ahmad Shah Abdali. Alexander the
    Great and Harshavardhan also have strong claims, but they might
    be disqualified for obvious reasons.

    In the course of his many abortive forays into India, Mohammad
    Ghori is said to have been captured once by the forces of Delhi.
    But Prithviraj Chauhan, king of Delhi, magnanimously let him off.
    Legend has it - and it is widely believed in India - that when
    Ghori eventually succeeded in defeating Prithviraj Chauhan at the
    Second Battle of Tarain in 1192, he blinded him and took him in
    chains to Afghanistan along with his friend, the poet
    Chandravardai.

    Ghori held a grand durbar to celebrate his victory. His prize
    catch, the king of Delhi, blind and a prisoner, was paraded and
    publicly humiliated. Deeply incensed by the treatment meted out
    to his monarch, Chandravardai took refuge to a subterfuge. He
    announced that though completely blind, Prithviraj could still
    hit a target guided solely by sound, and he asked for permission
    for this feat to be performed.

    Prithviraj Chauhan was handed a bow and arrow, and Chandravardai
    sang a now-famous verse which told him of the elevation and
    distance to Ghori's throne. And thus, guided solely by sound,
    Prithviraj shot his arrow through Ghori.

    The legend may not be entirely true, but it would be absolutely
    accurate to say that even after eight centuries have elapsed,
    Prithviraj is regularly subjected to indignity in the land where
    he was taken as a captive. I have seen it at first hand.

    Many years ago, while travelling by jeep from Kandahar to Kabul,
    I had to make a night halt en route at Ghazni. At the hotel, I
    learned that there was a grand mausoleum over the tomb of Sultan
    Mahmud Ghaznavi near the town, and I determined to see it. A few
    extra Afghanis (the local currency) helped my driver to
    comprehend the necessity of making a small detour the next
    morning.

    The mausoleum was indeed grand -judging by local standards - with
    a high, arched doorway like the Buland Darwaza. lie tomb proper
    was in a cellar about four or five feet be low ground-level. It
    intrigued me considerably to note that there were no steps
    leading down into the tomb. Instead, a metal chain hung from the
    ceiling of the cellar. I was told that I would have to hold the
    chain and jump down.

    I asked for the reason for this peculiar method of entry. The
    caretaker was evasive at first. But after much persuasion, he
    disclosed that there was another tomb at the exact spot where you
    jumped down. There, the infidel king of Delhi, Prithviraj
    Chauhan, lay buried.

    It is one of the obvious facts that D-Company has financed and supported(ing) lot of terror activities in India. I'm not able to understand why the Indian government is not taking steps to crackdown their illegal empire in Bombay. If the funding is stopped there will be a huge decrease in terrorist activities.

    Yes, India may not be able to go to war and catch Dawood in Pakistan but they can definitely start taking action against all the business and people supporting Dawood in Mumbai. I was surprised why nobody has talked or taken any action about this. Up to the time government start taking some sincere actions Indian people have to suffer like this.

    Agreed, lot of issues are internal. There are internal enemies and external.
    The govt is corrupt. What else can we say? Most of the elections are run on illegal money.
    Believe me, friend, there is going to be another attack, in some other city probably, and strong-minded indian citizens are going to ignore it like its another mosquito bite.
    If your parliament can be attacked and you can ignore it, you can perhaps survive anything.

    My primary reason for supporting Obama is environment...

    Obama truely supports renewable energy, and did not cave to placating the public with lowering gas tax. While I think that $15,000,000,000 per year may not be enough it is a start in the right direction.

    I got my green card earlier this year, and one of the first things that I did after getting it was contribute to Obama's primary campaign. Now I've been contributing to his election campaign (I'm sure that there's a public access site you can look up contribution at).

    McCain did not once vote for the Renewable Energy Investment Tax Credit extension. Not once out of 9 times. Sure he has been out of DC many times, but not all. How can you have an "all of the above" energy policy when you haven't voted once for renewable energy.

    Many of us high skilled immigrants have the above average get-up-and-go that it takes to move this country forward to a brighter future. After all we had the get-up-and-go to move here.

    However, the system does work against us. Being an "temporary" sure did not make it any easier making the investment that I have. Until I got my green card, being "temporary" was a huge problem and worry, because I had made decisions based on the assumption that would change.

    Friends,
    I need to find out how many people are interested in pursuing this option, since the whole interfiling/PD porting business (based on a year 2000 memo) can seriously undermine the EB2 category.

    I am currently pursuing some initial draft plans with some legal representation, so that a sweeping case may be filed to end this unfair practice. We need to plug this EB3-to-EB2 loophole, if there is any chance to be had for filers who have originally been EB2.

    More than any other initiative, the removal of just this one unfair provision will greatly aid all original EB2 filers. Else, it can be clearly deduced that the massively backlogged EB3 filers will flock over to EB2 and backlog it by 8 years or more.

    I also want to make this issue an action item for all EB2 folks volunteering for IV activities.

    Friend... Your post is obviously selfishly motivated... and shortsighted. I'm sure if you were EB3 you would not make the same logical suggestion that you claim to be logical based on your self centered thinking.

    What you're suggesting is make it even more difficult for anyone to change jobs (then it already is)...

    Don't get too comfy with your EAD card, god forbid you might just get a RFE your AOS can get rejected, then you'll realize why your PD should be portable :D

    I am an EB3 2003. I think I did qualify for EB2, but the job position did not require me to be in that category, moreover EB2 & Eb3 were both current and various other factors were considered and they decided to apply in EB3.
    NOW: It was my bad that I got stuck in the stupid BEC. A fellow I know with lesser qualifications applied in EB3 in 2004, then changed jobs, applied in EB2 in 2004 and has a green card already.
    DO YOU MEAN TO SAY: THAT YOU ARE GOING TO DENY ME MY 2003 PD IF I APPLY IN EB2. FORGET THINKING ABOUT IT! Not that it is easy or I am doing it. As a matter of fact, I am not interested!.

    An old man lived alone in Minnesota. He wanted to spade his potato garden, but it was very hard work. His only son, who would have helped him, was in prison. The old man wrote a letter to his son and mentioned his situation:

    Isn't the employee-employer relationship between employee and the consulting company ?
    Why should USCIS get into the details of how the companies conduct their business ( like asking for client letters etc ) ?
    Is USCIS supposed to do this?

    USCIS probably does that to identify whether the job offer is bonafide. Especially with the rampant misuse of the system I am guessing thats how they make sure that all these problems like benching without pay, layering, working on lower salary and higher per diems are weeded out

    Painful as it may sound -- to say the least it is in our(employee's) long term interest. Though it appears as though its a measure designed to be against the spirit of at will employee-employer relationship I think its going to cleanse the system and make it more viable for everyone -- clients, employers and employees

    I have been reading this thread with a lot of interest and could not hold back from commenting on the unbridled optimism many of you guys are showing towards the housing market, which reminds me of the "long tailed" euphoria that followed long after the NASDAQ had crashed over 50% in 2001 after the tech bubble, and people kept wishing it would come back long after it became clear to most cynical observers that it would take decades to achieve the same levels as before (and it hasn't yet)...

    Housing has not yet bottomed. It still has a long way to go. You guys may think that the foreclosures related to subprime resets have subsided so the market may recover. You haven't seen anything yet. Consider:

    Option ARMs (adjustable rate mortgages) and Alt-A ARMs are the next two shoes to drop. In case you've had your head buried in the sand, the economy is on verge of a collapse. Unemployment is soaring and many more companies are considering layoffs. Many economic observers are opining that we are already in recession.

    Desi junta, and others, I entreat you readers to please consider this seriously in your house purchase decisions. If for some reason you need to sell and move out, at a minimum you will be saving some money (by not losing your downpayment, for example) by choosing to rent. Rent a house/townhouse from a private owner if you are tired of renting an apartment and have growing kids - it's a "renters market" in the private rental marketplace right now with so many investment properties purchased during the housing bubble available for rent.

    here is a good prediction. for 5 years housing is going to be a lousy investment when you take inflation into account !!!
    to be honest, I would have bought a house this year because of tax credits ..but articles and predictions like this make me feel good. I guess those who are in similar situation can THANK USCIS for GC delays / visa wastage

    Lobbying Reform, at Last (http://www.washingtonpost.com/wp-dyn/content/article/2007/07/30/AR2007073001552.html) Congress should finish it before going home, July 31, 2007

    IT WASN'T EASY, it took too long, and it's not done yet -- but before Congress leaves for its August recess, it should have completed a lobbying reform bill that would, for the first time, require disclosure of the bundles of campaign checks that lobbyists bring in for politicians. We say "should have" because the measure -- having not gone through the normal conference committee process -- needs to clear significant hurdles in both the House and Senate. Lawmakers of both parties, in both houses, must ensure that that happens before going home to face constituents who appear increasingly unhappy about a Congress they perceive as looking after its own interests, not theirs.

    The lobbying package makes important changes, some of which were written into House rules in January. It would prohibit lawmakers and staff members from accepting gifts or travel from lobbyists and their clients. It would end lawmakers' ability to fly on corporate aircraft at cut-rate prices; senators and White House candidates would have to pay regular charter rates for such flights, while House members would simply be barred from accepting travel on private jets. It would lengthen, from one year to two, the revolving-door prohibition on senators and Senate staff members; the House limit would remain at one year.

    It would require that senators pushing pet projects known as earmarks make that information available at least 48 hours in advance of a vote and certify that they and their immediate family members have no financial stake in the items; earmarks added in conference could be challenged and would have to receive 60 votes to survive. Lobbyists would also have to report gifts made to presidential libraries, now a financial disclosure black hole.

    Most important, the measure would require lawmakers to include on their campaign finance reports the identities of lobbyists who raise $15,000 or more for them during a six-month period -- shining a needed light on an important source of influence. Keeping this requirement part of the bill was a difficult, and important, achievement.

    This agreement will be brought up on the House floor today, under rules allowing it to pass quickly with two-thirds support. Then it goes to the Senate, where it is expected to run into opposition from Republican Sens. Jim DeMint (S.C.) and Tom Coburn (Okla.) over whether the earmarking rules are strict enough; because it involves a change in Senate rules, 67 votes will be needed for passage. Leadership from Minority Leader Mitch McConnell (R-Ky) will be critical to ensure that the complaints of a few senators are not allowed to derail a change that is badly needed and long overdue.

    Anyways the fact of the matter is that we are in a limbo, all indications point to Obama becoming the next president of US. if CIR 2008 was any indication , we as EB applicants are royally screwed if Sen Durbin dictates his immigration policy. What is the use of talking about wars and innocent people when chances are that the advocate of his immigration policy is opposed to my main issue of EB reform. high low Taxes, 401k's, houses, Medicare etc will matter if you get to stay here in the first place. A average 6-9 years of paying taxes, supporting medicare and Social Security and we now need to think about moving to different countries where skilled immigrants are welcome....think about it. Just look at the CIR 2008 discussion to understand what i am talking about. Read the senators transcripts.



    Ramayan was an epic written long time ago. It is a story(like stories in bibble). Creationism evolved just to oppose evolution theory and cause confusion to the evolution theory. They say it is based on science, when it is not. BTW evolution is also a fact, it is not just theory.

    Spending on needless wars are not helping economy. With this economy there is little chance for GC. If everybody wants tax cut, who will pay the debt. Keep borrowing? Some one has to pay the interest at the least..
    Clinton balanced the budget, while taxing the rich. McCain is for the 'trickle down economy' which we now see what it really is(DOW down 800 points). Obama is for tax cut for the average guys and not for the 'trickle down economy' scam.

    Yes, you are right, the recent 485 denials for people using AC-21 have nothing to do with Obama/Durbin immigtaion policy. But I kind of remember there were some harsh provisions for people using AC 21 in CIR 2007 version. I am trying to find out the details about it.
    Correct me if I am wrong.

    AC21 denial is nothing to do with immigaration policy of Durbin or Obama. It is due to lack of regulations in USCIS or USCIS not efficient to follow the law/rules or bad customer service. This is where we need Obama. Becuase, he is favor of more/stright regulation or more accountability or strong government.
