Do my employer need to file I-140 within 45 days of labor certification? Is this a law now?

Has anyone been in a situation where they joined a new employer after having completed 180 days after 485-filing, and sent in AC-21 documentation through an attorney?
If so, which attorney did you choose for the AC-21 paperwork?
- The old attorney, that represented you and your ex-employer, and filed your labor, 140, 485, EAD, AP
- or the attorney representing the new company
- or a third attorney that you went and found on your own
What do you think is the best way to go, if there is a best way to go?

H1b from non-cap to cap cannot be transfered. In order for you to work in private companies, you need to get new H1b by filing in on april 1 st 2009 which will ahve start date of oct 2009. Untill then you are stuck ..!!!
However you can transfer your present H1b to another non-profit h1b. I know the rules sucks..I ahve been in your place and got H1b this time. Can't wait to to get freedom on oct 1st.

Experts,
I am planning to use AC21 and start a new job on EAD, although the reason I am telling my present employer is that I am going to home country and may or may notcome back. what happens if the employer revokes the H1B or can he ask uscis to stop all the immigration matters with me. I have finished 180 days hatch period ...:)

hi
i have been offered a job at my current research centre where i worked as a student. I want to go back to my home country. The job can be done online and does not require physical presence in the USA. Will i still need an OPT? or can they employ me as an international worker? if they wmploy me as an international consultant then what are the ramifications for teh company? wht is the legal procedure? will they have to pay taxes more etc?
Please help

Hi,
I had an approved I-140 from my previous company with a priority date of Nov 2005. I moved to a new company, and my GC was applied again in Dec 2006. My previous I-140 was used to retain my priority date. However, my new I-140 from this company shows the priority date of Dec 2006.
How do I make sure that my previous priority date (Nov 2005) is on file, and my case will be filed according to that.

Want to wish you a happy, healthy, fun filled, relaxed and sun shine new year.
Make a new year resolution that has positive impact on your life style. :D
I personally will try to loose 10 pounds, Switch from Beer/Scotch to Wine (can't gaurantee leaving scotch :p and will do some certifications and keep bright faces of my kids and my wife always in front of me and in my mind if I do get discouraged.

one of my friend worked here on L1 for couple of years for employer A.
then he got a H1 approved effective from Oct'07, with employer B.
but, he did not actually start working under employer B on H1 (payroll) until Mar'08.
he continued working under employer A on L1 ( has paystubs without any break) until Mar'08 and then worked with employer B on H1.
now he did a cap-exmpt H1 transfer to employer C, got H1 apporved and they are filing for GC labor PERM petition.
question is, while providing his previous employers info in the PERM petition,
can he say that he worked with employer A on L1 until Mar'08, even though his H1 with employer B is effective from oct'07?
appreciate any advice

I am kind of confused about my situation. Will try to detail it; any help is greatly appreciated!
I was working with company A until July 2009. They had filed my F1 to H1 COS Application in April 2009, which got approved. I have the receipt for that. I lost my job in July 2009 and found another one. My new employer, Company B, filed a NEW COS Application (which they said is subject to the H-1B cap, which is confusing cuz they could have used the receipt number from my previous approval I think)
Anyway, I contacted the attorney from Company B and they said I should call company A and have them cancel my H-1 COS Application. I called the attorney from Company A and she said she would cancel the H-1 Application. She also mentioned about ME having to send a letter to USCIS. Why do I have to send this letter? Is it so that I can go back to my F1 status? What should it say?? Please help!

Greencard requirement says one has to reside 183 days per year to maintain continuous residency requirement.

YOu should go ahead and file your response to RFE. I had the same issue with my case when my attorney did not inform me of a RFE. After missing the deadline, I filed my repone through a different attorney explaining the problemand USCIS accepte my response.
