I have reached the last 9 days of the 90 day unemployable clause in the OPT period of F1. I had an internship for three months and now am looking for a temp/ internship Job. I would really appreciate it if someone can direct me to one.

Change of Status to F1: 12/2001
Change of Status to H1: 10/2004
Labor Filed Substitution: 07/2007
Appeal: 11/2009 in process
I calculated my time in USA excluding time spent outside the country and my 6 years will end in June 2010. When my employer renewed H1 back in 2008 he simply claimed for 3 years and USCIS approved till 03/2011. But I read somewhere online that we have to calculate our time spent in the country and should not go by the date that is on our H1.
1. Does the change of status from H1 to F1 reset the H1 time period or do we have to consider that time period while calculating the 6 years
2. As my application (AAO) is pending I heard I will get a one year extension. The question I have is can I stay on my current H1 till 03/2011 or do I have to renew my H1?

Hi Gurus:
My wife got H1B approved in this year cap with validity date from October 1 2009. She is going to India for vacation during August 2009 and planning to go for H1B stamping.
My question is, whether she can go for stamping before October 1, 2009 which is the start date mentioned in I797 or she should go for stamping only after October 1,2009 ??

Does the I-485 filing date matter? i.e. If one person files their application on July 1st and the other files on say July 25th (due to some reasons), will their I-485's get processed in FIFO?

Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.

My manager got an email from USCIS saying my I140 is approved and they will mail the approval notice. Online case status show that approval notice emailed. But we haven't received any emails about the approval notice. Do USCIS sent paper approval notices??

I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.
Does this happen often ?

Once we receive EAD and all 9 yards notices and once you switch from H1 to EAD system with same employer, are you still bound to work with same employer for full 40 hours.. can you cut your hours to 20 hours (nooo second job too). I can just work 20 hours a week . Is that permissible to be on EAD and still get GC processed?

Just realized that some thing is wrong with the USCIS web site. When I open my portfolio , I see an LUD on my EAD with 10/16/2007. (Today is 10/9/07)
My AP LUD date changed to 4/16/2007 (Not even applied in April 07).
Could this be DST bug ?

However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.

Hi,
My EAD got expired in July and I got the Denial Notice of the H1B petition last week. My lawyer thinks it's got rejected because of my salary change and address change. So she's going to file a new H1B petition on a nunc pro tunc basis. What is nunc pro tunc? Is my case eligible to file such a petition?
And if not, what other options do I have?
Please give me some advice, any advice you think might work. Thanks!
