My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

Your Employer can file extension of I-94 till Feb 2011. No need to go outside the country.

I need small help from you. I filed my EAD on july 17th and aug 2nd my green card is approved. I got mail from USCSIS that my application, fees and all supporting documents are returned due to either invalid fees or document is not signed which is not a case becauase i filed efile and paid by credit card and i sent them all supporting document. I guess they return because my GC is approved.
So can i claim fees paid my credit card back ? is there any body in same situation ? they mentioned in letter that fees will be back but i do not see that is case.
Appriciate if you help to understand that if they will give me money back or not.. i called customer services and they told me that i can not get it back but they were not sure.

I recently got my EAD card. I intent to continue to work full time with my current employer. I want to work part time with another employer. My H1 is stamped and valid untill end of 2008.
If I use my EAD card for part-time job, does my H1 get invalid?
If yes, do I need to inform my fulltime employer about change in status?
If no, can I travel outside USA with the H1 visa for reentry?

continuedProgress: AFAIK & IMHO - Only people in valid H/L status can travel outside USA while AP is pending. Your wife is on F1, if she travels outside USA with out the approved AP on hand, her 485 is considered abandoned. You can have second opinion with your attorney.

I have MBA(marketing) Degree from India and 90 Hour Early Childhood Certification and CPR Certificate.
I have been offered a job for the position of LEAD KINDERGARTEN TEACHER in a private CHILD CARE CENTER in MD.
Query :
A) Does the above JOB qualify as H1B?
B) I checked on FLCDATACENTER to determine the prevailing wage for this job - All Industries Database has a higher preveiling wage than what I am offered. Can I use any other wage source?

do you get a FP notice only if you file AP and EAD along with your 485 ?
FP is for 485. so even if you dont apply for AP or EAD, u should still get FP notice.

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

I want to request everyone - Members and non member ( they will have to sign up at IV) to please update the all the information for the tracker.
Please update any communication that you may have had with USCIS, like RFE, Reciept notice and any other information.
This information can be very useful to IV for generating reports and talk to the officials confidently with data and looking at the trends .. say for RFEs or something else.
Anonymous users please sign in at IV using any ID , and update all the information related to any communication in the past with USCIS.
I would request everyone , that after updating the profile please post a comment to this thread , so that this floats on the home page for a couple of days, so that more and more users can read it and update their profiles

I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

I am July 2nd filer and got EAD approved.
My 485 notice has Received Date as July 19th 2007 and Notice Date as October 17th 2007.
Do i need to calculate 180 days from July 19th 2007 OR Oct 17th 2007 if i want to change the jobs?

OFLC is working to rectify this situation immediately by identifying the affected cases, and reinstating them back to the appropriate processing status in proper order. This effort will be completed by November 30, 2006.
Although affected employers and their attorneys will NOT be receiving an additional notice of reinstatement, they may verify their case has been reinstated using the Public Disclosure System (PDS) starting December 1st. Since verification will be available online, employers and attorneys are requested not to contact the Backlog Elimination Centers regarding status.
